LATEST ROUND IN RACETRACK BATTLE GOES TO DEVELOPERS

UPDATE

Despite a victory before the DHEC Board in September of 2003, which sent the issue of the racetrack back to their staff for further review, Audubon South Carolina and its conservation partners returned to Court on November 7, 2005 following an appeal by the developers of Interstate Speedway. The ruling by Judge Markley Dennis of Berkeley County found in favor of the developers, reviving the racetrack project after many years of successful battles by Audubon and its friends.

STOPPING THE RACETRACK

In 2001 the developers of the Interstate Speedway signed an agreement with Berkeley County, agreeing to abandon their plans for a racetrack in exchange for a change in their zoning category. The County granted their zoning change in the spirit of that agreement. Mr. Chris Holmes, attorney for the developers, made the statement following the November 7th hearing that the developers "are free to start moving the dirt on this project". There will be no dirt moved for a racetrack without Berkeley County first granting the developers a return to their original zoning category. Audubon South Carolina and its friends will now focus on holding the developers to their agreement and preventing any zoning change that will allow a racetrack to be constructed.
